Terms Of Agreement

1. Agreement

a. The payment of the consideration for the service rendered shall be construed as acceptance of these terms of agreement.

b. For the purposes of this agreement, Nakiso Borehole Drilling shall be the contractor and the client shall be the person in whose name this receipt is raised or his agent.

2. The Contractor

a. Agrees to drill on the site indicated by the client and to install standard casing from top to bottom except where a specific request has been made by the client or his agent.

b. Drill a borehole with no guarantee or promise that water will be found. In the event of a dry hole, the contractor is not liable, and all payments are due as per contract.

c. Due to the nature of equipment (large and heavy) damages may occur to the driveways, gardens, sanitary works, durawalls etc. The contractor will try by all reasonable means to avoid damage but it shall not be liable for any damages that may occur.

3. The Client Shall

a. Ensure that the site is safe and free from fire or electrical hazard.

b. Ensure that all necessary clearing to access the drilling site as required by drilling staff is carried out beforehand.

c. Ensure that there is a representative to confirm the depth of drilling, flushing casing or installation and signing the drilling report before machinery leaves the site.

d. Accept that the onus of having a representative on site is on the client. In the absence of such representative, the contractor shall carry on to commence and complete the Job.

e. The Contractor will not be held responsible for applying for permits to drill on the client's property, nor for registering of the borehole.

4. Delays & Penalties

a. Any delays caused by the client (siting, site clearing, waiting for funds, barring machinery) shall attract a penalty levied at 20% of the contract amount. If the contractor delays on drilling on the agreed date the contractor shall give the client 24 hours notice.

5. Right To Stop Drilling

a. The contractor reserves the right to stop drilling on reaching the depth recommended on the siting report or the depth agreed and paid for.

b. When difficult drilling conditions are encountered which may prevent reasonable drilling process or pose unacceptable risks to staff/equipment.

6. Dry Holes & Casing

a. If at the agreed depth, insufficient water supply is obtained, the decision to drill deeper is entirely up to the client.

b. It is up to the client to decide whether to case the dry hole. If the hole is to be cased it cannot be deepened later because of the size of the casings used.

c. If the client decides to leave the borehole uncased, and the hole collapses, the contractor will not be liable.

7. General Terms

a. All equipment and consumables remain the property of the contractor.

d. The standard drilling depth is 40m. Any extra depth will be charged on a separate contract at a rate of at least $45.00 per metre.

e. The contractor shall supply a standard of 40m PVC Class 9 casing.

f. Mileage is charged at a rate of at least $3.50 per running kilometre for all out of Harare sites.

g. Siting is the sole responsibility of the client.

8. Terms Of Payment

a. Full payment must be made for the full cost of the contract prior to drilling. Any invoices incurred due to delays are required to be paid on presentation.

9. Additional Incidental Charges

a. Where the underground formation requires an additional construction casing (not part of primary casing), this will be installed and charged at a minimum of $20.00 per metre.

10. Refunds

a. Where a client has made payment and no longer wants the services, this shall be communicated to the contractor and a refund shall be processed within five (5) working days.

11. Installations

a. The installation charge is for a standard depth of 40m and a swap distance of 20m between the borehole and the power source/water connection point. Where distances differ, additional costs may be incurred.

Fact 1: Know Your Borehole Casings

The Preferred Borehole Casing In Zimbabwe Is Class 9 and 10 (Pressure Classes.)

This is because Class 9 and Class 10 Casings are more collapse resistant. The strength of a Casing is often described as collapse resistance.

Fact 2: Borehole Drilling Depth

The exact depth, of where the water is located, cannot be established by the drilling contractor nor the Water Surveyor (Borehole Siter).

Fact 3: There Is No 100% Guarantee

It is important to note that it is never a 100% guarantee that any hole will yield water, the amount and water quality can also not be guaranteed by the drilling contractor and water surveyor.
